A Socio-Legal Study of Custodial Violence in India

Abstract

Police, one of the coercive forces of the governance who is assigned with the task to maintain law and order in the society. Justice Krishna Iyer in Prem Chand (Paniwala) v. Union of India And Ors2said who will Police the Police? It is disappointing and despicable that we as civilized people continue to stand at the crossroad, asking ourselves the same question from past many years. Police atrocities on the detained prisoners are increasing day by day. Recent incidents brought the entire nation to look upon the data of custodial deaths. In 2019, the number of custodial deaths averaged to over five persons per day.3 Not only in India but in other countries as well custodial torture is prevalent. In June 2020 the United States may have witnessed largest movement taken out globally on “black lives matter ” which clearly shows the brutality of Police. With all these atrocities police are violating the human rights of the prisoners and no action is against them. India also needs some stringent laws and enforcement regarding custodial violence. Through this paper the researcher has tried to analyze the problems and facets of custodial violence through socio-legal study and the methodology adopted in this research paper is both empirical and non-empirical work to analyze the qualitative study of the harrowing reality of violence by police officials.
