Culpable homicide not amounting to murder - cardiac deaths and opinion expression Murty O P, Additional Professor Forensic medicine and Toxicology, All India Institute of Medical Sciences, New Delhi, 110029. Abstract In this paper, the art of opinion expression is discussed in cases related to 304 IPC - Culpable Homicide not amounting to murder, in deaths of persons having underneath cardiac pathology. In these cases atmosphere is charged up with the allegations of murder by the relatives, but investigators and doctors remain in a dilemma as-what to say? and How to say? at this juncture. In these deaths underlying natural disease and its involvement requires answers to mainly two questions - 1. Whether a lesion present in the person is incompatible with life? 2. Whether the lesion present in the person is known to cause death? Few examples are discussed in this paper with an objective to give some lead to new Forensic Experts/doctors undertaking autopsies and find it difficult to express opinion.
