Abstract

Human beings have with creativity intellect and skill have been instrumental in technology and Innovation and now in the past decade machines have become more intelligent and are making creative and innovative choice based on algorithms thus, making it perplexing. The use of AI is expanding across the globe and there is a need for regulation of the same. In India at present there is no codified Law, statutory rules or even Government issued guidelines that regulate AI. In the near future AI would be involved in Inventions and create a threat to patent systems. This paper focuses on analysing the need of IP laws to be in tandem with the technological developments. It is time that these enactments are amended to accommodate more advanced and sophisticated Technology and legislations must be able to keep pace with this fast technological progress and the IP system can be shaken up by AI with the basic issues of inventorship, authorship, ownership and infringement. Hence the urgent need to make changes in the existing laws to ensure an effective IP regime, and the harmful socio, economic, ethical implications can be averted. This paper highlights the need for a balance of the disruptive impact of AI and the delivery of the solutions for the social good. Regulation is necessary to enlarge AI and manage the rules associated with it.
