The main factors causing an imbalance in market is monopoly. The monopoly leads to the creation of dominant position and consequently economic disease. For this reason some countries have enacted laws to prevent monopoly. For example, the United States of America ratified the laws of Sherman and Clayton. Given that, mentioned two laws, were called antitrust, in this paper, using descriptive and analytical methods have been tried, first, the Trust will be examined and then, its relationship with monopoly will be analysed. Our efforts have found this result, that the monopolies which been formed in the United States, is caused by abuse of the common law trust.
